Please be aware that purchasing any item from www.boori.com/au (“site”) constitutes your unconditional acceptance of these Terms and Conditions of Sale, as well as our Website Terms of Use, Privacy Policy, Acceptable Use Policy and any other pages we have referenced on this page.

Boori reserves the right to update or modify these Terms and Conditions of Sale at any time without any prior notice. Your use of our site following any such modifications constitutes your agreement to abide by the Terms and Conditions of Sale as modified.

Payment

  1. Our site currently accepts MasterCard and Visa as payment options.
  2. You authorise Boori to debit the amount that is payable in respect of a selected order from you in accordance with your nominated payment option.
  3. In order to purchase products from our website, you must be the authorised user of the credit or debit card, at least 18 years old, and legally permitted to enter into legal contracts.
  4. Our site also currently accepts payment via Zip Pay or Zip Money. You can find more information about these services here.
  5. You must not pay for a product using any unlawful means.
  6. You must provide us with information that is accurate, complete and not misleading.
  7. To the extent permitted by law, Boori is not liable to you for any loss or damage caused by your order failing to be transmitted through our system due to any reasons beyond our control such as electronic or telecommunications failure.

Boori’s Acceptance or Cancellation of an Order

  1. Boori reserves the right, at our sole discretion, to cancel any orders for any reason, including stock unavailability, and errors in product information. If Boori cancels your order, we will contact you and issue a refund.

Cancellation Policy for Boori Online Store

If you wish to cancel your Boori online order, please do so as early as possible, as there are potential financial penalties, and limitations if you cancel too late.

  1. If you cancel your order prior to its dispatch, Boori can cancel the order and provide you with a full refund.
  2. If Boori cannot stop the shipment of the order at the time of cancelation, then you will be required to refuse delivery or return the product/s to receive a refund. The product/s must be returned in their original condition and in their original packaging within 14 days of purchase date. Boori will not refund any shipping or handling costs, and you will be charged a restocking fee of 20% the cost of your order. You will also be responsible for any costs involved in the return delivery.
    1. Hardware items and textile products may be excluded from the 20% restocking fee if they are returned unopened and in their original condition.
  3. You cannot cancel your order if you have already received your goods. However, if there is an issue with your items, you may be eligible for a return, repair or refund. For more information, please refer to our Returns Policy.

Pricing

  1. All prices listed on our site are in Australian dollars, and inclusive of GST.
  2. Prices associated with the delivery of your items are calculated and shown in the checkout. Shipping costs depend on the product/s ordered and your delivery address. For more information about delivery fees, please refer to our Delivery Information page.

Product Information Accuracy

Despite our efforts to ensure information on our website is kept up-to-date and accurate, the Boori site occasionally contains errors or omissions related to pricing, stock availability or descriptive content.

  1. If a purchase is made of a product with inaccurate information, Boori reserves the right to cancel any orders placed for that item and amend the errors.
  2. If an item is mis-priced, Boori will notify you of the error, cancel the order and issue you a full refund.
  3. If an ordered product is out of stock, Boori will cancel the order, communicate the stock unavailability to you, and issue you a full refund.

Product Variations

Your product may exhibit slight variations to the images shown on the website.

  1. Each piece of timber is unique and as such, each timber product will vary in the pattern of the woodgrain
  2. Though Boori has tried to ensure that colours are faithfully represented in the images and colour swatches on our website, we cannot guarantee that the colours shown on your computer screen are a completely accurate portrayal of the actual colours.

Delivery of Product/s

  1. Products on our site can only be purchased by Australian residents with a delivery address in Australia. Some items have additional postcode restrictions that limit them to delivery in only certain metro areas.
  2. Boori usually uses third-party courier or specialist furniture delivery services to send goods.
  3. Timeframes for delivery described on Boori’s Delivery Information page are only an approximation. Boori cannot guarantee that your product/s will arrive within these timeframes.
  4. Boori will not be liable for any delay in receiving your goods where the delay is caused by factors beyond our control.
  5. You must supply a delivery address that is within Australia. If you are ordering furniture or mattresses, your delivery address must not be a PO box.
  6. You must have someone 18 years or older at the the delivery address in person to accept and sign for the delivery of your order.
  7. You must notify Boori of any potential difficulties regarding the delivery such as stairs, difficult parking or narrow corridors.
  8. If the delivery worker is not able to successfully deliver your goods because there is no one at home, the delivery address you have provided is incorrect, or you have not properly warned of potential obstacles, Boori reserves the right to charge you for any additional costs incurred.
  9. If no one is available at your delivery address at the time of delivery, the delivery worker may leave a card notifying you of the attempted delivery. Please contact the delivery company to organise a new date for delivery.
  10. Once the products you have ordered have been delivered to your nominated delivery address and signed for, title and risk in the products pass to you.
  11. If the product/s you order are particularly heavy, you must be prepared to provide assistance to the delivery worker in carrying the product/s.
  12. Boori advises that you check your items and report any damage or faults to us within 72 hours of receiving your delivery.
  13. Boori can only hold an order to be dispatched for a maximum of one week. After that, you will incur a storage fee of $10 per business day.

Collection of Product/s

  1. Payment in full is required before you can collect your product/s
  2. Boori will notify you once your order has been prepared and is ready to be picked up.
  3. Our warehouse is open Monday to Friday 8am to 4:00pm.
  4. All orders must be picked up within five business days of notification. Failure to do so will incur a storage fee of $10 per business day.
  5. When collecting your product/s, you must bring your order invoice and a suitable vehicle.

Authority to Leave Terms & Conditions

You may request Authority to Leave by ticking the Authority to Leave option at the Boori checkout, or contacting Boori staff via email. By requesting Authority to Leave, you agree to the below:

  1. You authorise the postage/delivery company to leave your item/s unattended at the delivery address you have provided.
  2. You agree that the item/s are considered received once left at your premises.
  3. You agree to release Boori from and against any and all claims, demands, liabilities, losses, costs and expenses, including financial and other consequential losses, suffered or incurred by you or any other person or entity as a result of using the Authority to Leave delivery method.

Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. For further information on this, please refer to our Refunds and Returns Policy.

Returns or Damaged Goods

  1. Please choose your purchases carefully as Boori does not normally provide refunds where you have simply changed your mind or made a wrong selection.
  2. Any returns where no consumer guarantees have been violated will result in a 20% restocking fee. The item must be returned in its original condition, in its original packaging and with the original sales invoice, within 14 days of the purchase date. You will not be refunded any shipping costs. You will also be responsible for any costs involved in the return delivery.

  3. Boori advises that you inspect your product/s within 72 hours of delivery or during collection.
  4. If you receive the incorrect item, please contact services@boori.com.au as soon as possible. We will send you the correct product once the incorrect one has been returned.
  5. If your goods arrive damaged or faulty:
    1. Please contact services@boori.com.au as soon as possible with any images or videos you deem relevant to help communicate the damage
    2. Do not attempt to return the damaged goods on your own
    3. Boori will assess the damage, whether through images, video or in person, and contact you with options for how to proceed
    4.  
  6. For hardware orders, please ensure that you select the correct items. If you are unsure, please contact services@boori.com.au. If you order the incorrect hardware, you may return them to us. We will refund the cost of the items but not the shipping.
  7. Please refer to our Refunds and Returns Policy for more information about our returns policy, including your rights under the Australian Consumer Law.

Exchange of Products Policy

  1. Due to risk of transport damage, Boori does not allow for an exchange of products for change of mind purchases of any timber products.
  2. Boori does allow for change of mind product exchanges for non-timber products such as hardware, textile products, or mattresses. Products must be returned in their original condition, in their original packaging, and with their original sales invoice within 14 days of purchase date. You must pay for any shipping costs involved.
  3. If you change your mind shortly after placing an order and Boori have yet to dispatch the item, Boori can offer an exchange of products.
  4. All change of mind product exchange requests are subject to stock availability.
  5. All change of mind exchanges are at Boori’s sole discretion. Boori reserves the right to refuse a change of mind product exchange request if Boori believes it does not comply with these conditions.

Boori Warranty

Boori provides a Warranty Against Defects for all our products. Please note that any benefits provided to you by a Boori warranty are in addition to other rights and remedies available to you under the Australian Consumer Law.

  1. The Warranty Period for your product will vary depending on the type of product purchased.
  2. All Clearance furniture comes with a 12 month Warranty only.
  3. All Warranty Periods begin from the original date of purchase.
  4. To be eligible for this warranty, you must be the original purchaser of the product and provide proof of purchase.
  5. This Warranty is only for products purchased in Australia for non-commercial use.
  6. Warranty information is included in a document that comes with the purchased product.
  7. You can register your Warranty with us using our Warranty Registration page.
  8. You can lodge a warranty claim at the place of original purchase as set out on your receipt for purchase of the Boori product/s, by contacting Boori's service team at services@boori.com.au, or via our Warranty Claims page.

Force Majeure

Boori will not be liable for any delay in performing any of our obligations if such delay is caused by circumstances beyond our reasonable control, including but not limited to, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.

Governing Law

  1. Nothing in these Terms and Conditions of Sale excludes, restricts or modifies any guarantees or rights you may have under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any similar legislation of the state of New South Wales.
  2. Boori Australia Pty. Ltd. is located in Eastern Creek, NSW. These Terms of Use are governed by and construed in accordance with the laws of the state of New South Wales in Australia.
  3. You unconditionally agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
  4. If any provision of these Terms and Conditions of Sale is found to be invalid or unenforceable by a court of law, such provision shall be modified only to the extent to make it valid and enforceable. Additionally, such invalidity or unenforceability will not affect the remainder of these Terms and Conditions, which will continue in full force and effect.
