These are the Terms and Conditions for purchases made at a Boori retail store. Boori stores are operated by Boori Australia Pty Ltd (ACN 160 962 354) (“Boori”, “we”, “our”, “us”). This information is provided to the Consumer (“you”) to inform you of the terms and conditions of your Boori store purchase.

Payment

  1. A minimum deposit of 20% the invoice price must be paid when placing an order.
  2. Lay-bys are limited to a maximum of 12 weeks duration.
  3. Any price quotations are only valid for a period of seven days.

Delivery

Boori requires payment in full prior to delivery. Most Boori store orders are delivered by 3rd party services. Upon receiving confirmation of full payment being received, Boori will contact you within three business days to schedule the delivery. Please read below for important information regarding your delivery.

  1. You must provide us with the correct delivery address, and notify us of any potential difficulties regarding the delivery such as stairs, difficult parking or any access issues. If you live in apartment, please inform us of any important information about loading dock access.
  2. You must have someone 18 years or older at the the delivery address to accept and sign for the delivery of your order.
  3. If we are not able to successfully deliver your goods because there is no one at home or you have not properly warned of potential obstacles, Boori reserves the right to charge you for any additional costs incurred.
  4. Once the products you have ordered have been delivered to your nominated delivery address and signed for, title and risk in the products pass to you.
  5. Deliveries are made to the front door of the house/ground floor of the building. The delivery person is under no obligation to take product/s into a specific room. 
  6. If you need to cancel and reschedule the delivery date, please do so at least one business day prior to the original delivery date.
  7. Each order is restricted to a single delivery, unless otherwise specified by Boori. Additional delivery charges will apply if you request multiple deliveries without prior agreement.
  8. Boori advises that you check your items and report any damage or faults to us within 72 hours of receiving your delivery. If your goods arrive damaged or faulty:
    1. Please contact us as soon as possible with any images or videos you deem relevant to help communicate the damage.
    2. Do not attempt to return the damaged goods on your own.
    3. Boori will assess the damage, whether through images, video or in person, and contact you with options for how to proceed.
  9. Once your order has been processed and your goods are ready for delivery, Boori can only hold your items in our warehouse for a maximum of one week. After that, holding your goods at our warehouse will incur a storage fee of $10 per business day.

Pick-up From Our Warehouse

Boori offers a free pick-up option from our warehouse in Eastern Creek NSW 2766.

  1. Please do not attempt to pick up your goods until Boori has processed your order and made sure of stock availability.
  2. Boori will notify you once your order has been prepared and is ready for pick-up. You must pick up your goods within 5 business days of notification. Failure to do so will incur a storage fee of $10 per business day.
  3. Larger, bulky goods can only be picked up from our warehouse in Eastern Creek, NSW.
  4. Our warehouse is open Monday to Thursday 8am to 2:00pm, and Friday 8am to 12pm.
  5. You are responsible for bringing an appropriate vehicle and any additional material needed to protect and secure your goods during transport.
  6. After you have signed for your goods and they have left our warehouse or store, full responsibility of the goods passes onto you, and Boori is no longer liable for any damage that the goods may incur.

Pick-up From One of Our Boori Stores

For in-store purchases of smaller items with packed dimensions under 10kg, Boori offers an in-store pick-up option.

  1. Please do not attempt to pick up your goods until Boori has processed your order and made sure of stock availability.
  2. Boori will notify you once your order has been prepared and is ready for pick-up. You must pick up your goods within 5 business days of notification. Failure to do so will incur a storage fee of $10 per business day.
  3. Larger, bulky goods with package dimensions over 25kg cannot be picked up from stores. Please contact the Boori store if you have questions about whether an item is eligible for store pick-up.
  4. Stores are usually staffed by a single person, and can therefore provide only minimal assistance during pick-up. When picking up your item/s, you are responsible for ensuring that you have sufficient manpower, any necessary moving equipment, an appropriate vehicle, and any additional material needed to protect and secure your goods during transport.
  5. After you have signed for your goods and they have left our store, full responsibility of the goods passes onto you, and Boori is no longer liable for any damage that the goods may incur.

Free Sydney Metro Delivery Terms & Conditions

  1. Free shipping offers are given at the sole discretion of Boori Australia.
  2. Free delivery offers are limited to delivery-to-the-door services. Additional delivery services eg. room delivery may incur additional charges.
  3. An order cannot be split across multiple deliveries, and deliveries cannot be put on hold for over two weeks.
  4. Boori's current free delivery promotion applies to deliveries to the Sydney metro region only and is for a limited time. Assembly

Boori do not offer our own assembly services. However, if you ask our friendly staff, they can provide contact details for third party assembly services.

Cancellation Policy

  1. Orders are subject to a cancellation fee of 20% the cost of the product/s.
  2. You may be excused from paying this cancellation fee if your goods do not arrive within the timeframe communicated to you by Boori.
  3. Orders cannot be canceled if your goods have already been dispatched. If you would still like to return the product, please refer to our Returns and Refunds Policy below.

Returns and Refunds Policy

  1. If you would like to return goods that have already been dispatched, you must do so within 7 days of the delivery date. These goods must be in their original, unopened condition and in their original packaging.
    1. Returning all the items in your order will incur a fee of 20% the invoice total, and you will not be refunded any shipping charges.
    2. Returning only part of your order will incur a fee of 20% the price of the products returned.
  2. Consumer Guarantees
    1. Under the Australian Consumer Law, you have guaranteed legal rights for goods and services you purchase. These are called consumer guarantees; these cannot be excluded and are in addition to any extended warranty your product/s might come with.
  3. You are entitled to ask for a refund or replacement if your goods do not meet one of the following consumer guarantees:
    1. the item is of merchantable quality ie. the goods must meet a level of quality and performance that would be reasonable to expect given the price and description
    2. the item is fit for the intended purpose as communicated by Boori
    3. the item you bought matches the description given to you or the display model shown to you
    4. the item has spare parts and repair facilities available for a reasonable time after purchase unless told otherwise
  4. Boori is not obligated to provide you with a refund, repair or replacement when consumer guarantees do not apply; this includes if you:
    1. have simply changed your mind or made a wrong selection
    2. discover you can buy the goods cheaper elsewhere (except where we guarantee that goods cannot be purchased cheaper elsewhere)
    3. have misused the product in any way that contributed to the problem
    4. knew of or were made aware of the faults prior to purchasing the product
  5. Boori shall not accept returns for opened goods that do not violate any consumer guarantees, unless Boori chooses to do so at its absolute discretion. If Boori chooses to accept such a return, you must pay an amount which in Boori’s reasonable view reflects the loss that Boori will suffer as a consequence of this return.
  6. Repairs, Replacements and Refunds
    1. In the case of a minor problem, Boori may offer you replacement part/s so that you may repair your product, or send a repair technician to carry out the repairs.
    2. In the case of a major problem, you have the right to ask for a replacement or refund.
    3. Any requests for replacements or refunds must be made within a reasonable time of receiving the goods.
    4. If you are requesting for a replacement or refund, you must ensure that you:
      1. have taken reasonable care of the goods
      2. have not damaged the goods by using them in a way they were not meant to be used
      3. are able to prove that you purchased the goods from a Boori Kids store or Boori authorised reseller.
    5. Replacements are subject to stock availability. If a product cannot be replaced, we will offer you a refund instead.
    6. Refunds will be processed via credit card. These will normally be processed within three business days.

Boori Warranty

All Boori Kids products come with a Warranty Against Defects. For more information about the Warranty, please refer to the Warranty document that comes with your purchased product.

  1. Any benefits provided to you by a Boori Warranty are in addition to other rights and remedies available to you under the Australian Consumer Law.
  2. The Warranty Period for your product will vary depending on the type of product purchased.
  3. Discontinued goods come with a 12 month warranty.
  4. Ex-display goods do not come with a warranty but are covered by Australian Consumer law protections
    1. Under the Australian Consumer Law, you have guaranteed legal rights for goods and services you purchase. These are called consumer guarantees; these cannot be excluded and are in addition to any extended warranty your product/s might come with.
  5. All Warranty Periods begin from the original date of purchase.
    1. To be eligible for this warranty, you must be the original purchaser of the product and provide proof of purchase.

Floor stock and ex-display products

All floor-stock, and ex display items are purchased in an 'as is' condition. These items cannot be returned and refunded due to change of mind reasons. It is the responsibility of the customer to inspect these items prior to purchase. Please note that these items do not come with a warranty, but are covered by Australian Consumer Law protections. The sale and discounting of floor-stock, and ex display items is at the discretion of Boori Australia staff.

Your Rights Under the Law

  1. Nothing in these Terms and Conditions excludes, restricts or modifies any guarantees or rights you may have under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law or any similar legislation of the state of New South Wales.
  2. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, such provision shall be modified only to the extent to make it valid and enforceable. Additionally, such invalidity or unenforceability will not affect the remainder of these Terms and Conditions, which will continue in full force and effect.

Force Majeure

Boori will not be liable for any delay in performing any of our obligations if such delay is caused by circumstances beyond our reasonable control, including but not limited to, failure of or interruption in the provision of essential services such as electricity supply, bank payment systems or postal deliveries.
